Under New York Law, the consent of a biological parent or any person having custody of the child is not required for an adoption when there is evidence of an intent to forego parental rights to the child. Failure to visit the child for a period of six months or to communicate with the child or person that has legal custody of the child although able to do so is evidence of the intent to forego parental rights. Although a case would be easiest when there is a properly executed consent to the adoption, the law does not require the consent under the circumstances as mentioned above.
